Lenders and Mortgage Servicers do not have the capacity to effectively ensure that they are in compliance with foreclosure laws and statues. Oftentimes, lenders employ a "third party" Trustee Company or Attorney to administer the foreclosure process on behalf of the lender; consequently transferring the liability to the Trustee or Attorney for any violations of foreclosure laws and/or statutes.
Home Retention Services requires that the Trustee or Law Firm verify a comprehensive list of items related to the procedures enacted by the lender and/or Trustee during the foreclosure process. Since the Trustee or firm assumes all liability in the auctioning of the property, they will not foreclosure on the property if there is potential for any violation of foreclosure laws or statutes. This would lead to potential litigation.

There are numerous grounds for which a foreclosure auction and/or sale can be reversed, just as there are numerous claims that can be brought up for postponement of the sale. The Lenders are liable under Consent Orders issued for ROBO-SIGNING and not properly ensuring policies and procedures related to foreclosures were followed. Home Retention Services provides Trustee Sale Reversal services that will enable the owner to stay in their property or move back in. Trustee Sale Reversal is not permanent, however typically the lender must start the foreclosure process all over again. This only provides property owners additional time to determine what the next best course of action is.

- If Only 3-Day Notice to Vacate is posted we can delay the eviction a minimum of 6 months, up to 12 months.
- If the Unlawful Detainer has been issued, we can delay the eviction a minimum of 4 months, up to 8 months
